1. General Provisions

1.1. These General Terms and Conditions (“GTC”) apply to participation and the associated ticket sales for the aforementioned event, hosted by the organizer. Divergent terms and conditions of the participant shall not be valid.

1.2. The organizer reserves the right to amend and supplement these regulations. Any changes or additions shall become effective upon publication on this website or on the event page mochni.com/consciousloft.

2. Registration and Conclusion of Contract

2.1. Registration for participation in the event is exclusively possible via the organizer’s event management platform.

2.2. The organizer makes an offer for the conclusion of a purchase contract with the information provided on the website. The participant accepts this offer by completing the ordering process and clicking the “Request Invitation” button in the final order mask. The effective acceptance of the offer by the participant requires that the participant has filled in all required fields (marked with “*”) in the order mask and has accepted these GTC.

2.3. The contract for participation in the event is only concluded after the organizer has confirmed the registration to the participant in writing via email. Amendments and/or supplements to the contract must be made in writing. This also applies to the waiver of the written form requirement.

2.4. Professional Audience: The event is aimed exclusively at traders, freelancers, and companies. By registering, the participant declares that participation occurs exclusively in the exercise of their commercial or self-employed professional activity. A contract conclusion with consumers (§ 13 BGB – German Civil Code) is excluded. The organizer reserves the right to reject registrations that do not meet these criteria.

3. Prices

3.1. The price stated in the booking confirmation is binding for the participant.

3.2. The ticket prices stated are net prices in Euros. In addition, the statutory value-added tax applicable at the time of service provision shall be charged.

3.3. If special prices for discounts are granted, these are stated separately. If no discounts are stated, none can be granted.

4. Payment and Ticket Reservation

4.1. Due Date: Payment of the ticket price is due immediately upon receipt of the invoice, at the latest within 3 days, without deduction. The booking is only confirmed as binding after full receipt of payment.

4.2. Payment by Invoice / Default of Payment: If payment is not received within the specified period, the organizer is entitled to cancel the contract with immediate effect (withdrawal). In this case, the claim for participation in the “Conscious Loft” expires and the reserved ticket may be assigned elsewhere. A reminder is not required for this if the due date is determined by the calendar.

4.3. Fees: Fees incurred through bank transfers or other payment methods (especially for international transfers) are to be borne in full by the participant.

5. Withdrawal, Cancellation, and Replacement Participants

5.1. Binding Nature: Registration for the event is binding. Upon receipt of the registration confirmation/invoice, the full ticket price is due. There is no right of withdrawal or refund of the ticket price in case of non-participation – regardless of the reason.

5.2. Exceptions: The statutory right to extraordinary termination for good cause (§ 314 BGB) remains unaffected.

5.3. Commercial Character: By registering, the participant declares that they are attending the event in the exercise of their commercial or self-employed professional activity. The event serves exclusively for professional exchange and continuing professional education among professional peers.

5.4. Replacement Participants: The participant is entitled to name a replacement participant. However, the organizer reserves the right to reject the participation of the replacement person without giving reasons, especially if they do not belong to the professional audience intended for the event. The designation must be made in writing or by email, including the full contact details of the replacement participant. No rebooking fee applies. The original participant remains liable for the payment of the fee to the organizer.

6. Services

6.1. The scope of the contractual service for the event is derived from the information materials, the details on the event website, any existing registration forms, and the organizer’s registration confirmation. In case of discrepancies, the service description in the booking confirmation shall prevail.

6.2. If services are not provided in accordance with the contract, the participant is entitled to remedy. Defects must be reported immediately. Claims for reimbursement of the participation fee due to services obviously not provided in accordance with the contract must be made within 14 days after the end of the event.

6.3. The organizer reserves the right to appoint a substitute speaker in exceptional cases. The participant will be informed of any such changes in good time.

6.4. Travel, accommodation, and catering are not included in the event offer unless such services are expressly listed in the event description. If a contracting party does not utilize services properly offered, in whole or in part, there is no claim for a refund of the participation fee.

7. Cancellation of the Event

7.1. The organizer may cancel the event for urgent reasons with reasonable notice. This also applies to framework and evening programs.

7.2. In the event of cancellation, the organizer will refund the payment made in full within 14 days. Any other costs incurred by the participant will not be reimbursed.

8. Copyright and Other Rights

8.1. Lectures and provided event documents are protected by copyright and may only be used for personal purposes. Rights of use are only transferred by express written grant of rights. Reproduction, distribution, processing, or public reproduction of any kind is generally not permitted and requires the written consent of the organizer.

8.2. Audio and video recordings and descriptions of the event or event results, in whole or in part, are not permitted.

9. Image Material/Photographs

9.1. The participants of the event irrevocably and gratuitously consent to the organizer’s right to create, reproduce, broadcast, or have broadcast, and to use in audiovisual media, images and/or sound recordings of their person that go beyond the reproduction of an event of current affairs.

10. Liability

10.1. The organizer is liable:

  • For intent and any negligence in the case of breach of essential contractual obligations. Liability is limited to the amount of the participation fee; liability for consequential and pecuniary damages (e.g., lost profit) is excluded.
  • Otherwise, only for damages caused by intent or gross negligence. Liability is limited to the amount of the order sum; liability for consequential and pecuniary damages (e.g., lost profit) is excluded.
  • 10.2. These liability limitations and exclusions do not apply to:
  • Claims under the Product Liability Act;
  • Claims due to fraudulent conduct of a contracting party;
  • Claims from liability for guaranteed characteristics;
  • Damages resulting from injury to life, body, or health.
  • 10.3. Furthermore, the organizer and its vicarious agents are not liable for disturbances of any kind caused by circumstances outside their area of influence.
  • 10.4. Liability for damages arising during travel to and from the event locations, as well as for losses and accidents, is excluded – to the extent permitted by law.

11. Final Provisions

11.1. The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Hamburg.

11.2. Should individual provisions of this contract be ineffective or lose their effectiveness due to a later circumstance, the effectiveness of the contract shall otherwise remain unaffected. The ineffective contractual provision shall be replaced by a regulation that comes closest to what the contracting parties would have intended if they had considered the point. The same applies to gaps in this contract.

11.3. The place of performance is the registered office of the organizer.
